Singapore Marathon

This document outlines the agreement between you (the “Participant”) and Explor42 (“the Company”) for the tour package (“the Tour”). By booking and paying for the Tour, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.

1. Services Provided

   The Tour package includes a confirmed race entry (marathon bib) or tickets for the specified event and other services such as accommodation, transfers, and support as detailed in your specific tour itinerary. The marathon bib / tickets is a core component of the package.

2. Booking & Payment

   A deposit is required to secure your booking. Full payment is due no later than 90 days before the tour start date. Bookings made within 90 days of departure require full payment at the time of booking. All prices are quoted per person.

3. Cancellation and Refund Policy
   1. Cancellation by the Participant:All cancellation requests must be submitted in writing via email. The following cancellation charges apply, calculated from the date we receive your written notification:
      • More than 90 days before departure: Loss of deposit.
      • 89 to 60 days before departure: 50% of total tour cost.
      • 59 to 30 days before departure: 75% of total tour cost.
      • Less than 30 days before departure: 100% of total tour cost.
   2. Non-Refundable Items:Please note that the cost of the marathon bib and any associated registration fees are strictly non-refundable and non-transferable under any circumstances. This amount will be deducted from the total tour cost before any percentage-based refund is calculated. Any other non-recoverable costs incurred by the Company, such as non-refundable flight or hotel payments, will also be forfeited.
4. Assumption of Risk and Indemnification
   1. Health, Fitness, and Medical Issues:
      • The Participant acknowledges that running a marathon is a physically strenuous and potentially hazardous activity. The Participant is solely responsible for their own health, physical fitness, and medical condition. It is your responsibility to consult with a qualified medical professional to ensure you are fit to participate.
      • By booking this Tour, you voluntarily assume all risks associated with participation, including but not limited to, falls, contact with other participants, effects of weather, traffic, and course conditions.
      • You agree to indemnify and hold harmless Explor42, its employees, agents, and partners from any and all claims, liabilities, damages, and expenses (including legal fees) arising from any injury, illness, disability, or death you may suffer before, during, or after the marathon event.
   2. Visa, Passport, and Travel Documents: 
      • The Participant is solely responsible for obtaining all necessary travel documents, including a valid passport, visas, and any required health certificates.
      • Explor42 is not responsible for and will not be held liable for a Participant's failure to obtain the correct travel documents.
      • In the event of visa rejection or denial of entry to a country, no refund will be provided, and the cancellation policy (Section 3) will apply.
   3. Marathon Event Cancellation or Alteration (Force Majeure): 
      • Explor42 acts as an agent to secure the marathon bib and arrange travel services. The Company is not responsible for the organization or execution of the marathon event itself.
      • n the case that the marathon event is cancelled, postponed, or altered by the official race organizers for any reason (including but not limited to weather, terrorism, pandemic, natural disaster, or political instability), Explor42 will not provide a refund for the marathon bib or any non-recoverable costs.
      • The Company will endeavor to recover and refund other portions of the tour package from third-party suppliers (e.g., hotels, transport), but this is not guaranteed.
5. Travel Insurance

   It is a condition of booking that the Participant must have comprehensive travel and medical insurance. Your insurance must cover marathon participation, trip cancellation, medical expenses, personal liability, and repatriation. You are responsible for ensuring your policy provides adequate coverage.

6. Governing Law

   This agreement shall be governed by and construed in accordance with the laws of India. Any disputes arising from this agreement will be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.
